David Koster PA, operator of the South Florida Condo Network ("the Network," "we," "us," or "our"), respects your privacy. This Privacy Notice explains how we collect, use, disclose, and protect personal information when you visit yourbeachclub.com or any other building-specific website in the Network that links to this Notice, including any pages or services that link to it (each a "Network Site" and collectively, the "Site"), submit a form, request information or a showing, select listings you are interested in, sign up for alerts, or otherwise communicate with us.
The Network is a group of real-estate information and marketing websites. Brokerage services displayed or offered through the Site are provided by ONE Sotheby's International Realty and/or appropriately licensed real-estate professionals or brokerages. We are responsible for the personal information we process for our own purposes. A brokerage or real-estate professional that receives your information may process it under its own privacy notice and legal obligations.
We are not affiliated with the buildings, associations, management companies, or developers featured on the Site. Information you submit through the Site comes to us, not to the building or its management.
Please read this Notice carefully. If you do not agree with it, please do not submit personal information through the Site. This Notice does not apply to websites, applications, brokerages, agents, or services that we do not control, even if the Site links to them.
"Personal information" means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked with an individual or household. The term does not include information that has been aggregated or deidentified so that it cannot reasonably identify you.
Depending on how you use the Site, we may collect:

Because the Network Sites are operated together, information you submit on one Network Site may be used to respond to you about related buildings or services across the Network, and may be combined with information you submitted on another Network Site or on other websites operated by David Koster PA (such as PenthouseLife.com and EstateLife.com), consistent with this Notice.

The receiving professional, brokerage, or developer may contact you directly and may process your information under its own privacy notice. David Koster or another affiliated real-estate professional may receive a referral fee or other transaction-based compensation, paid through the applicable brokerage, if a referral results in a completed transaction. We do not authorize recipients to use your inquiry information for unrelated purposes.
We do not share your inquiry with the building's association, management company, or front desk.

These providers may process personal information only as needed to provide services to us, subject to their agreements with us and applicable law. Embedded-content and messaging providers may also process information under their own privacy policies. Vendor names and functions may change as our services evolve.
We may disclose information when we reasonably believe disclosure is necessary to comply with law, regulation, subpoena, court order, MLS or professional obligation, or another lawful request; protect the rights, property, or safety of the Network, our users, or others; detect or prevent fraud, abuse, or security incidents; or establish, exercise, or defend legal claims.
We may also disclose or transfer information in connection with an actual or proposed merger, financing, acquisition, reorganization, bankruptcy, sale of assets, or similar business transaction, subject to appropriate confidentiality protections where required.
We may disclose information when you direct or authorize us to do so or when disclosure is otherwise clearly requested by your interaction with the Site.
We do not sell personal information for money and, based on current Site configuration, do not use personal information for cross-context behavioral advertising. We use analytics tools to understand use of our Site, subject to consent where required.
David Koster or an affiliated real-estate professional may receive a referral fee if a referral results in a completed transaction. Some U.S. state privacy laws define a "sale" broadly enough that a compensated referral could be treated as a sale even though we do not sell personal information as a standalone product. To the extent an applicable law treats such a referral as a sale, you may opt out as described in Sections 9 and 10. An opt-out request will not affect disclosures you direct us to make or disclosures reasonably necessary to respond to a property-specific request, except as required by applicable law.
We do not knowingly sell or share the personal information of individuals under 16 years of age.

Our cookie categories are essential, preference, and analytics cookies, plus cookies set by embedded third-party content (such as Google Maps and YouTube) when that content loads. We do not intentionally deploy advertising cookies. Analytics technologies are loaded only after you select Accept in the Site's cookie banner where that choice is offered; if you select Decline, we use only the cookies needed to operate the Site and remember your choice.
You can also control cookies through your browser settings. Rejecting or deleting some cookies may prevent certain features, such as embedded maps or video, from working correctly. Browser-based "Do Not Track" signals are not interpreted consistently across the industry. Where legally required and technically supported, we will treat a recognized universal opt-out preference signal, such as Global Privacy Control, as a request to opt out of the applicable processing.
We may email you about your inquiries, showing requests, requested listing alerts, and other requested services. Where permitted, we may also send marketing communications. You may unsubscribe from marketing emails and alerts using the link in the message. Even after you unsubscribe from marketing, we may send non-promotional messages necessary to respond to a request or provide a service you requested.
If you provide a telephone number, we may call or text you about the inquiry or service for which you supplied it, subject to applicable law. We send marketing calls or texts using automated technology only with the consent required by the federal Telephone Consumer Protection Act, the Florida Telephone Solicitation Act, and other applicable law, obtained through a separate disclosure or checkbox. Consent to receive marketing calls or texts is not a condition of purchasing property or services. If you separately consent to marketing text messages, message frequency may vary and message and data rates may apply. You may opt out of texts by replying STOP and request help by replying HELP. Carriers are not liable for delayed or undelivered messages.
If you contact us through WhatsApp, your messages are transmitted through and processed by WhatsApp under its own terms and privacy policy.
We do not sell, rent, or disclose telephone numbers or SMS opt-in information to third parties for those third parties' own marketing or promotional purposes. We may disclose such information to service providers as necessary to deliver requested communications and to real-estate professionals as needed to respond to the inquiry that you submitted.
The Site displays real-estate listing information supplied by MiamiRE through Bridge Data Output and may display information from other MLSs, brokerages, developers, public records, or licensed data providers. This property data is supplied to the Network and is distinct from personal information collected from Site users.
MLS/IDX information is provided for consumers' personal, non-commercial use and may be subject to separate attribution, accuracy, permitted-use, and disclaimer requirements displayed on the Site. Listing information is deemed reliable but is not guaranteed and may change or be withdrawn. Nothing in this Privacy Notice changes any MLS/IDX terms, Site terms of use, or listing disclaimer that applies to property information.
We may use artificial-intelligence services to help generate or translate editorial, building, and listing-related content and to support technical operations. We do not intentionally submit inquiry messages or other user personal information to an AI content-generation service. AI-generated content may contain errors and is reviewed or used subject to our editorial and Site practices.
We retain personal information only for as long as reasonably necessary for the purposes described in this Notice, including to provide requested services, maintain appropriate business and real-estate records, comply with legal and contractual obligations, resolve disputes, enforce agreements, and protect the Site.

Retention may be longer when required by law, litigation hold, regulatory requirement, MLS obligation, or reasonably anticipated legal claim. When information is no longer required, we may delete, anonymize, deidentify, or securely dispose of it.

Describe your request, tell us which Network Site you used, and provide enough information for us to identify the relevant records. We may verify your identity before acting on a request. Verification may require confirmation of your email address, telephone number, or other information reasonably connected to your relationship with us. We will use verification information only to process the request.
Where permitted, an authorized agent may submit a request for you. We may require proof of authorization and may ask you to verify your identity directly. We will not discriminate or retaliate against you for exercising an applicable privacy right. We may deny or limit a request where permitted by law — for example, where we cannot verify identity or must retain information for legal, security, transactional, or recordkeeping reasons.
If we deny an appealable request, our response will explain how to appeal. You may appeal by emailing [email protected] with the subject line "Privacy Appeal" within the period provided by applicable law.
This section supplements the rest of this Notice for California residents and uses terms defined by the California Consumer Privacy Act, as amended ("CCPA"). It applies only if and to the extent the Network is subject to the CCPA.

We collect, use, and disclose these categories for the purposes described in Sections 2 and 3. We do not knowingly collect sensitive personal information through the Site, and we do not use or disclose sensitive personal information to infer characteristics about you.
We do not sell personal information as a standalone product or use it for cross-context behavioral advertising based on the current Site configuration. As explained in Section 3, however, a compensated real-estate referral could be treated as a sale under a broad statutory definition. California residents may submit any applicable request to know, access, correct, delete, or opt out using Section 9. We do not offer financial incentives in exchange for personal information.
California's "Shine the Light" law may permit certain residents to request information about disclosure of personal information to third parties for their own direct-marketing purposes. We do not disclose personal information to third parties for their own direct marketing except as disclosed with your direction or consent.
Residents of states with applicable comprehensive privacy laws may have the rights described in Section 9, subject to the scope, thresholds, definitions, and exceptions in those laws. This may include rights to confirm processing; access, correct, delete, or obtain a portable copy of information; opt out of a sale, targeted advertising, or certain profiling; and appeal a denied request. We will respond as required by the law applicable to the request.
Nevada residents may submit a verified request to opt out of a future sale of covered information, as defined by Nevada law, using the contact information in Section 15.
This section applies when the processing of personal data is subject to the European Economic Area ("EEA"), United Kingdom ("UK"), or Swiss data-protection laws.

Subject to applicable law, you may request access, correction, deletion, restriction, portability, or object to processing, and may withdraw consent. You may lodge a complaint with the data-protection authority where you live or work or where you believe a violation occurred. Please contact us first if you are comfortable doing so; we would appreciate the opportunity to address your concern.
Personal data may be transferred to and processed in the United States and other countries that may not provide the same level of protection as your jurisdiction. Where required, we use recognized safeguards, such as approved standard contractual clauses and contractual protections provided by our processors. You may contact us for information about applicable transfer safeguards.
If applicable law requires us to appoint an EEA or UK representative or data-protection officer, this Notice will be updated with the relevant contact information.
We maintain reasonable administrative, technical, and organizational safeguards designed to protect personal information. These measures include transport encryption (HTTPS), controlled administrative access, software updates, spam and abuse protection, and security monitoring. No transmission or storage system is completely secure, however, and we cannot guarantee absolute security.
The Site is intended for adults seeking real-estate information and services and is not directed to children. We do not knowingly collect personal information from children under 13. If we learn that we collected such information, we will take reasonable steps to delete it. A parent or guardian who believes a child supplied personal information may contact us as described below.
