David Koster PA, operator of the South Florida Condo Network ("the Network," "we," "us," or "our"), is committed to equal housing opportunity and to the letter and spirit of applicable fair-housing laws. We do not discriminate in access to housing information, listings, advertising, alerts, referrals, or real-estate services on the basis of any characteristic protected by applicable law. This Notice applies to yourbeachclub.com and every other building-specific website in the Network that links to it (the "Site").
We support the principles of the federal Fair Housing Act, the Florida Fair Housing Act, and the fair-housing and human-rights ordinances of Miami-Dade, Broward, and Palm Beach Counties and of the cities where the buildings we feature are located.
We support advertising and marketing practices designed to provide equal access to housing opportunities without unlawful barriers, preferences, limitations, steering, or exclusion.
Federal law. The federal Fair Housing Act prohibits housing discrimination because of race, color, religion, sex, disability, familial status, or national origin.
Florida law. The Florida Fair Housing Act (Sections 760.20–760.37, Florida Statutes) provides protections based on race, color, religion, national origin, sex, disability, and familial status. Florida law also extends disability protections to persons with, or perceived as having, HIV or AIDS.
County law where our featured buildings are located. County ordinances add further protections:
Municipal law. Individual cities may provide additional protections. The characteristics protected and the scope of those protections vary by jurisdiction. Where applicable law provides broader protection, we follow that broader protection.
Familial status generally includes households with children under 18, persons who are pregnant, and persons securing custody of children.
Fair-housing protections for persons with disabilities include rights relating to reasonable accommodations in rules, policies, practices, or services and, where applicable, reasonable modifications to dwellings, subject to applicable law.
Listings, market tables, listing alerts, and other housing information on the Site are based on property characteristics, listing information, user-selected criteria, availability, and other legitimate housing-related factors.
Protected characteristics are not used to suppress listings, restrict access to housing information, or otherwise discriminate in the availability of housing opportunities. We do not falsely represent that housing is unavailable, or provide different housing information, terms, access, or services, because of a protected characteristic.
We do not steer anyone toward or away from particular units, buildings, neighborhoods, communities, or geographic areas because of a protected characteristic. Every person who contacts us receives the same information, the same access to listings, and the same quality of service.
Our building profiles, amenity descriptions, market pages, maps, and editorial content are intended to describe properties, buildings, amenities, architecture, market conditions, and objectively relevant location information.
We do not characterize buildings or neighborhoods according to the race, religion, national origin, familial status, disability, or other protected characteristics of people who live or may wish to live there, and we do not suggest that a particular type of person or household belongs in a particular property, building, or neighborhood. Lifestyle descriptions on the Site describe a property's features and amenities, not who should live there.
Third-party information, including maps, transportation, and neighborhood information, may be displayed for informational purposes. It is not intended to express a preference concerning who should or should not live in a particular location.
Housing advertising and housing-related communications may not express an unlawful preference, limitation, or discrimination based on a protected characteristic. We do not target, exclude, suppress, or tailor housing advertising or outreach based on protected characteristics in a manner prohibited by applicable law.
Automated systems and AI-assisted features used on the Site are subject to the same fair-housing standards as human decisions. Protected characteristics may not be used by our automated systems to:
AI-assisted content may describe objective property and location characteristics but may not generate discriminatory housing preferences, demographic steering, or recommendations about where a person should live based on protected characteristics.
Nothing in this section prevents information from being used when reasonably necessary to provide an accommodation requested by a person with a disability or otherwise to comply with applicable law.
Users, advertisers, listing providers, property owners, developers, referral partners, brokers, agents, and other real-estate professionals may not use the Site to:
We may remove content, restrict use of the Site, discontinue a referral relationship, or take other appropriate action when we become aware of conduct that violates these principles or applicable law.
Licensed real-estate services offered in connection with the Site are provided through ONE Sotheby's International Realty or another appropriately licensed brokerage or real-estate professional. Each brokerage and professional is independently responsible for complying with applicable fair-housing, licensing, advertising, and professional-conduct requirements.
We route inquiries based on legitimate business factors such as the property, building, listing, brokerage relationship, licensing, and referral arrangement — not on a person's protected characteristics.
We are not affiliated with the association, management, or developer of any building featured on the Site and do not make association approval decisions. Condominium and cooperative associations are themselves subject to fair-housing laws when approving purchasers or tenants. In Broward County, an association that denies an application must give the applicant written notice of the reason for the denial within the time required by the Broward County Human Rights Act.
If you have a disability and need a reasonable accommodation to use the Site or to receive housing information or real-estate services through it — for example, information in an alternative format, a different method of communication, or help scheduling a showing — please contact us. We will work with you to provide reasonable access consistent with applicable law.
Requests for physical modifications to a property, or for accommodations in a building's rules, are governed by applicable law and are generally matters between the person making the request and the applicable property owner, landlord, condominium association, housing provider, or other responsible party.
We do not retaliate against, threaten, intimidate, coerce, or interfere with anyone for exercising a fair-housing right, requesting an accommodation, reporting a discrimination concern, filing a complaint, or assisting another person in exercising fair-housing rights.
If you believe you have experienced discrimination in connection with the Site or a real-estate professional, advertiser, partner, or other person you reached through the Site, please contact us:
